ECHL ONLINE TRANSMISSION POLICY

ECHL SOCIAL MEDIA POLICY FOR MEDIA ORGANIZATIONS AND FANS

Definitions:

Content – shall mean information about ECHL games while they are in progress.

Fans – shall mean all persons admitted to the arena on game day to watch an ECHL game.

Media Organizations – shall mean all media organizations and other entities and individuals that have been granted working media credentials or photo credentials to cover ECHL games and are engaged in posting Content on Social Media.

Social Media - shall mean any Content published or posted to the internet including any form of online or interactive media, including, but not limited to Facebook, Twitter, Foursquare, Pinterest, YouTube, Instagram, blogs, podcasts, message boards and websites.

The following conditions shall apply without exception to all Media Organizations:

(1) Content may be transmitted online only for news and editorial purposes and not for any commercial, advertising or promotional purpose without the express written permission of the ECHL or a Member.

(2) Online reports concerning ECHL games while they are in progress ("Online Game Reports") may not consist of play-by-play accounts or descriptions of games. Online Game Reports shall be limited to reasonable periodic updates. The ECHL will not object to Online Game Reports that are limited in frequency and detail (i.e. no more than three detailed status reports during each period) so as not to undercut authorized play-by-play accounts of games.

(3) Online Game Reports shall not use any audio, video or graphic simulations of game action. A reasonable number of photographs may be posted online for news and editorial purposes together with Online Game Reports. The ECHL will not object to the posting of up to an aggregate total of twelve (12) photographs of game action on a media web site while a game is in progress.

(4) Any photograph of ECHL game action posted on Social Media may be used only for news and editorial coverage of the game and not for any commercial, advertising or promotional purpose.

(5) Motion pictures or video of ECHL games may not be posted or transmitted online without the express written permission of the ECHL or the Home or Visiting Member.

(6) Any and all copyrights, proprietary interests and other incidents of ownership in and to ECHL games and accounts and descriptions of ECHL games shall remain vested in the ECHL, ECHL Properties, LLC or designated assignees or licensees and its Members.

(7) Television broadcasts of ECHL games shall be permitted only in accordance with Member license agreements or contracts approved by the Commissioner of the ECHL.

(8) Exempted from the operation of the ECHL Social Media Policy for Media Organizations shall be (i) any game-day live internet broadcasts in accordance with a license agreement from the ECHL; (ii) Content posted on Social Media by a television network entity granted rights pursuant to a contract with a Member; (iii) Content posted on Social Media by FloSports subject to license granted by the ECHL; (iv) such other rights to post Content to Social Media pursuant to specific license granted by the ECHL or a Member.

The following conditions shall apply without exception to all Fans:

(1) Content may be transmitted online only for news and editorial purposes and not for any commercial, advertising or promotional purpose without the express written permission of the ECHL or a Member.

(2) Motion pictures or video of ECHL games, or any portion thereof, may not be posted on Social Media without the express written permission of the ECHL or a Member.

(3) Video from ECHL.TV/FloHockey, either in part or in full, may not be posted online under any circumstances.
